Ideal Mobile App Privacy Statement (USA)

1)          Scope

a)          This Privacy Statement describes the general practices relating to the collection, use, and disclosure of personal information collected by Ideal Talent Systems (“Ideal” or “we”) or any affiliate in relation to the Ideal Flex Work Mobile Application (the “App”) and the data relating to your use of the App.

b)          This Privacy Statement does not apply to the personal information we collect through the App to establish and maintain an employment relationship with you. Please review the Ideal Employee Privacy Statement to learn how Ideal handles personal information related to your employment with Ideal.

2)          Personal Information Ideal Collects. Ideal may collect the following categories of personal information directly from you or your device when you download, sign up, and/or use the App, including:

a)          When you create an account, we collect personal information, such as e-mail address, first and last names, phone number, city, state/province, and zip code, and ask you to create your username and password.

b)          When you create and maintain an Ideal Worker profile in the App, such as your photo and contact information.

c)          Information about your device and other online identifiers such as your mobile device, mobile operating system version, phone carrier and manufacturer, device identifiers, mobile advertising identifiers, and push notification tokens.

d)          When you search for shifts or clock in or out on shifts, your precise location information when you grant access.

e)          Your use of the App and services made available through it.

f)           We may also collect other information you may choose to provide through interaction with the App.

g)          When you decide to use your device’s camera to take a profile picture or provide any information using your device’s camera or microphone, we will collect this information only when you grant us access to your device.

h)          When you contact our support center, we may record our interactions for compliance and training purposes.

3)          How Personal Information is Used.

a)          Ideal uses personal information to:

i)           Maintain your App account, verify your identity, and provide you with support.

ii)          Enable the App to perform all its intended functionalities, such as allowing you to find nearby job opportunities and workforce management-related functionalities (e.g., report work performed for Ideal, verify the location of your clocking-in/out, etc.).

iii)         Personalize and improve your experience while using the App.

iv)         Send general and/or personalized marketing communications related to the App and ancillary products and services. If you do not want to receive these marketing communications, you can do so by clicking the “unsubscribe” link provided at the bottom of every marketing e-mail, by replying STOP to the last SMS received, or by managing your preferences in the App.

v)          Send informational communications such as product alerts.

vi)         Develop and improve the App and ancillary products and services through research, development, analytics, and business intelligence.

vii)   Comply with data protection legislation, information security requirements, and other legal requirements.

b)          In the event that Ideal de-identifies personal information in support of legitimate business purposes, we will not attempt to re-identify the data.

4)          How Personal Information is Disclosed. Ideal may disclose your personal information in the following ways:

a)          Ideal Clients. Ideal clients are the companies that make job shifts and other opportunities available in the App. Ideal discloses to Ideal clients the information you add to your profile so that they can determine whether to select you for job opportunities. Ideal also discloses your contact information and profile picture to clients so they can contact you if needed and verify your identity in the event you’re selected for a job opportunity. b)          Service Providers. We may collect and share personal information from/with companies or individuals that help Ideal deliver its services or provide Ideal with services, such as those who help us prepare and distribute communications to assist and respond to your inquiries.

c)          Subsidiaries and Affiliates. We disclose personal information to subsidiaries and affiliates of Ideal in support of the uses described above.

d)          Business Transaction. In the event that Ideal or any portion of our assets are acquired, sold, or transferred, Ideal will disclose personal information to the company involved to complete the business transaction.

e)          Law Enforcement. We may report to law enforcement agencies any activities that we reasonably believe to be unlawful or that we reasonably believe will aid a law enforcement investigation into unlawful activity. In addition, we reserve the right to release your personal information to law enforcement agencies if we determine, in our sole judgment, that either you have violated our policies or the release of your personal information will protect the rights, property, or safety of Ideal or another person.

f)           Legal Process. We may share your personal information with others as required by or permitted by law. This includes sharing your personal information with governmental entities or third parties in response to subpoenas, court orders, another legal process, or as we believe is necessary to exercise our legal rights, to defend against legal claims that have been brought against us, or to defend against possible legal claims that we determine in our sole discretion might be brought against us.

5)          How Personal Information is Protected

a)          Ideal has implemented policies and procedures to protect personal information. Ideal uses recognized industry-standard security safeguards appropriate to the sensitivity of personal information. Ideal reviews its security policies and procedures on a regular basis and updates them as needed to maintain their relevance.

b)          Ideal makes reasonable security arrangements to protect personal information from and against risks, such as loss or theft, as well as unauthorized access, collection, use, disclosure, copying, modification, disposal, and destruction. The methods of protection include physical measures, organizational measures, and technological measures.  Ideal requires all third parties to whom it transfers personal information to maintain adequate safeguards in compliance with applicable laws and standards to protect personal information.

6)          Retention of Personal Information. Ideal will retain your personal information for as long as necessary to fulfill the purpose for which it was collected or as required to comply with legal obligations, and thereafter, Ideal will securely delete your personal information. If there is any personal information that we are unable, for technical reasons, to delete.

 

7)          How to Exercise Your Rights

a)          Ideal makes reasonable efforts to keep Personal Information as accurate, complete, and up-to-date as is necessary to fulfill the purposes for which the information is to be used. Unless Ideal is permitted or required by law to prohibit access, you can view and, if necessary, update and correct your Personal Information. Depending on the jurisdiction in which you are, you may have additional rights such as the right to request deletion of your Personal Information, the right to restrict or object to processing your Personal Information by Ideal, or the right to transfer your Personal Information to another organization.

b)          Individuals can submit requests for any of these rights by submitting an email request to privacy@ideal.com.

c)          Note that, as required by law, we will require you to prove your identity. We may verify your identity by phone call or email. Depending on your request, we will ask for information such as your name and contact information. We may also ask you to provide a signed declaration confirming your identity. In some circumstances, you may designate an authorized agent to submit requests on your behalf. We will require verification that you provided the authorized agent permission to make a request on your behalf.

d)         If you choose to exercise any of these rights, we will not discriminate against you or deny services to you, or provide different quality of services. Individuals can raise concerns or file complaints by emailing privacy@ideal.com. Ideal will investigate all complaints and take appropriate action to remedy any issues.

9)          Changes to this Privacy Statement. Ideal will update this Privacy Statement periodically to reflect changes to our privacy practices. We will provide notice in the App or via email when we make any material changes to this Privacy Statement.
